Serio v. Black, Davis & Shue Agency, Inc. (S.D.N.Y.)
The New York State Superintendent of Insurance retained E&C to investigate and pursue claims against persons believed to be responsible for the financial woes of certain failed or failing insurers. In one of these cases, E&C investigated the operations of an offshore captive reinsurer at the heart of an ill-fated workers’ compensation program. Among other things, this investigation traced the movement of millions of dollars in improperly withheld premiums to an offshore haven and the subsequent disbursement of those monies to the principals of the defendant back in the United States. Based on this investigation, E&C persuaded the court to, among other things, enter critical injunctive relief against the wrongdoers.
